The application form is fairly simple and was designed so that victims and survivors would not have to hire an attorney to assist them in applying for compensation.Your advocate should be able to answer most questions regarding the application procedure and will be available to assist you throughout the process.

Once the Victim Compensation Division of the Attorney General's Office receives the application, it verifies that the crime occurred, that the claimant is eligible as a survivor for compensation, and that all bills submitted are legitimate.

It may take several months from the date of application before you will know if your application has been accepted and if so, the amount of the compensation you will receive.

Victims and survivors have three years from the date the crime occurred, or was reasonably discovered, to file for compensation.

Compensable Expenses:

Burial expenses ($4,000 limit)

Crime-related medical expenses

Crime-relatd mental health counseling for dependents and family members of homicide victims

Homemaker services (The victim, male or female, must have provided full-time housekeeping services as his or her sole occupation for one year preceeding the crime.)

Loss of support (Based on either the victim's earnings or the actual level of financial support provided at the time of the death, dependents in homicide cases only are eligible to receive compensation.)

Under the Victims of Violent Crime Act, dependents and family members of homicide victims may be eligible to apply for reimbursement from the Commonwealth of Massachusetts for certain stated out-of-pocket expenses, i.e., funeral and medical expenses, including counseling services for survivors, for which they would not be reimbursed by any other source. If eligible, compensation is also available toward loss of support. For example, if a victim has minor children whom he supported, they would be eligible to apply for compensation. In cases where a legal guardian has custody of minor children whose parents have been murdered, he or she may file for compensation on behalf of the children.
