Non-Compensable Losses:

Losses covered by health insurance, disability insurance, medicaid, medicare, free care, workers compensation, social security benefits, other public benefits, or gifts

Personal property (money, jewelry, etc.)

Pain and Suffering

Lost wages due to court appearances
Eligibility Requirements:

Victim must suffer physical or psychological injury or death as a result of a crime

Crime must be reported to police or other law enforcement authorities within five days after the crime occurred, unless there is good cause for delay

Claimant must cooperate with law enforcement authorities in investigation and
prosecution of the crime, unless claimant has a reasonable excuse for failing to cooperate

Claimant must suffer out-of-pocket losses of at least one hundred dollars

Claim must be filed within three years of date or reasonable discovery of crime
Steps In Processing A Claim:

1. Upon receipt of the completed application, the Victim Compensation and Assistance Division of the Attorney General's Office will acknowledge receipt of the claim.

2. The Division will conduct an investigation of the claim to verify the information contained in the application.
3. Upon completion of the investigation, the Division will notify the claimant of the administrative decision to pay or deny the compensation claim.

4. If the claim is approved for a specific amount and the claimant assents, the Division will request immediate payment by the Treasurer's Office.

5. If the claim is either denied or approved for an amount less than that for which the claimant applied, and he disagrees with the administrative decision, he may request reconsideration (to be filed within fifteen days of the decision). The claimant may also seek a judicial review of the administrative decision in the district court (to be filed within thirty days of that decision, or within twenty days of the decision on request for reconsideration).
